By accessing or using Moda ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Moda is an AI-powered fashion photography application that allows users to generate product shots, fashion shoots, and other fashion-related imagery using artificial intelligence technology.

3. User Accounts

To use Moda, you must sign in with your Apple ID. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Subscriptions and Payments

4.1 Subscription Tiers

Moda offers the following subscription tiers:

• Free: 5 image generations per month
• Pro ($19/month): 100 image generations per month
• Max ($199/month): 1,000 image generations per month

4.2 Billing

Subscriptions are billed monthly through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

4.3 Refunds

Refunds are handled by Apple according to their refund policy. Contact Apple Support for refund requests.

5. Acceptable Use

You agree NOT to use Moda to:

• Generate illegal, harmful, or offensive content
• Create deepfakes or non-consensual imagery of real people
• Infringe on intellectual property rights of others
• Generate content depicting minors in any inappropriate context
• Create content that promotes violence, hatred, or discrimination
• Attempt to bypass usage limits or security measures
• Use the service for any unlawful purpose

We reserve the right to terminate accounts that violate these guidelines without refund.

6. Intellectual Property

6.1 Your Content

You retain ownership of images you upload to Moda. By uploading content, you grant us a limited license to process that content for the purpose of providing the Service.

6.2 Generated Content

Subject to these Terms and applicable law, you own the images generated through your use of Moda. You may use generated images for personal or commercial purposes, provided such use complies with these Terms.

6.3 Our Property

Moda, including its design, features, and technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

7. AI-Generated Content Disclaimer

Content generated by Moda is created by artificial intelligence and may not always be accurate, appropriate, or suitable for your intended purpose. You are responsible for reviewing all generated content before use. We do not guarantee that generated images will be free from errors, biases, or unintended content.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODA IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless Moda and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue Moda at any time, with or without notice. We may also modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account by discontinuing use and canceling any active subscription.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
